Alchemist Terms of Service

1. Introduction

Welcome to Alchemist! We're excited to have you here. Before using our services, please take the time to carefully read, understand, and accept these Terms of Service and the corresponding Privacy Policy.

This is a legal agreement between the developer .ddominik (ID: 302885091519234050) ("we", "our", "Alchemist") and you ("your"). By using this Discord bot, its website, dashboard, and other related products (collectively referred to as "Alchemist", "Bot" or "Service"), you are agreeing to these Terms of Service.

For paid services, your contractual partner is Dominik Scheidel, c/o Postflex #5812, Emsdettener Str. 10, 48268 Greven, Germany. Full details are available in our Legal Notice.

In cases of doubt, the owner of the server on which Alchemist is used is held liable and is referred to as "you" in these Terms.

To fully understand and agree to these Terms, you must first read, understand, and accept Discord's Terms of Service.

2. About this Service

Alchemist is a bot for the chat and social platform "Discord" (accessible at discord.com), provided by Discord Inc. This service allows you to make use of Discord's public API.

Alchemist strictly follows Discord's "Developer terms" and does not knowingly abuse any of Discord's services. YOU ARE NOT ALLOWED TO USE THIS SERVICE OR ITS PROVIDED FEATURES OTHER THAN INTENDED.

3. License

You may use Alchemist and its services for any purpose, including commercial use, if not stated otherwise in these Terms. You may not reverse-engineer or otherwise attempt to derive source code from Alchemist.

5. Outages, Termination and General Service

Alchemist is free to use and will remain free. Every feature of the Bot is available to everyone at no cost. We additionally offer an optional paid subscription ("Premium"), described in Section 6, which adds extras on top of the free experience. Premium never removes, restricts, or places behind a paywall anything that is otherwise available for free. We are actively developing new features and fixing bugs to improve Alchemist and your user experience. Therefore we may add or remove features.

While we try to avoid disruptions, we cannot guarantee that there will not be an outage or change to the service and your server's settings may not be retrievable due to such outages or changes. We are not liable for any such outages or service changes.

You are free to stop using Alchemist's services at any time by removing Alchemist from your Discord server. Doing so will permanently delete your data from Alchemist's servers but may not delete any log or backup data. Records we are legally required to retain — in particular invoices and payment records, which German law requires us to keep for up to ten years — are excluded from this deletion.

6. Paid add-ons

Alchemist is free to use and will remain free. Everything that works today stays free for everyone. Paid add-ons only ever add features; they never remove, restrict, or place behind a paywall anything that is otherwise free.

We offer the following add-ons. Not all of them are available at all times.

• a) Alchemist Server Pro is a monthly subscription for one Discord server. It is bought by a member who manages that server (the buyer) and unlocks extra features for every member of that server. The buyer is our customer and the contract is with the buyer, not with the server or its other members. Price: €3.99 per month, including VAT.
• b) One-time purchases such as coin packs, perk packs, personal perks or permanent server unlocks. These are delivered once and are not recurring. The range of one-time items may change over time.

All add-ons are delivered automatically and immediately after payment.

Subscriptions renew monthly until cancelled. You can cancel at any time; the benefits stay active until the end of the period you have paid for. When a subscription ends, the features it unlocked stop applying, but nothing you configured is deleted, and they resume if you subscribe again. Where we describe an unlock as permanent (for example the custom bot profile), it stays after the subscription ends.

A server can hold only one active Server Pro subscription. If a second one is bought for the same server by mistake, no additional features are unlocked and you should request a refund from wherever you bought it.

You can buy add-ons on our dashboard (payment processed by Stripe) or inside Discord. Purchases made inside Discord are sold, billed, and refunded by Discord under Discord's terms; we only receive confirmation of the purchase. Prices are the same on both.

7. Right of Withdrawal (Widerrufsrecht)

If you are a consumer, you generally have the right to withdraw from a distance contract within 14 days without giving reasons.

Premium is a digital service that we begin providing immediately. When you purchase Premium, you expressly request that we begin performance before the withdrawal period expires and confirm that you are aware you lose your right of withdrawal once we have fully performed the service. If you withdraw before then, you owe us reasonable compensation for the portion of the subscription period already provided.

To exercise a right of withdrawal where it does apply, send a clear statement to [email protected]. Sending the notice before the deadline expires is sufficient to meet it.

8. Virtual Currency and Virtual Items

Alchemist includes virtual currency ("coins") and virtual items such as perks and badges. These exist only within Alchemist and have no monetary value. They cannot be exchanged for money, transferred outside the Service, or sold, and they are not refundable.

You receive a licence to use virtual items within Alchemist; you do not acquire ownership of them. We may adjust, reset or remove balances and items where necessary to correct errors, or to address abuse or exploitation of the Service.

Coins and permanent items you have already received remain in your account if your Premium subscription ends, but benefits that depend on an active subscription — such as reduced cooldowns, bonus experience and the Premium role — stop when the subscription ends.

Coin packs bought with real money are subject to the same right of withdrawal as other digital services; the coins themselves have no monetary value and cannot be exchanged back.

9. Third Party Services

Alchemist allows you to connect accounts of third parties to your server to extend its functionality. It's your choice whether to use these products and you should review any terms and policies provided by the third party before doing so.

9.1. Social Media Notifications

By using Alchemist's social media notifications service, you agree that Alchemist reads information from your connected social media accounts (YouTube, Twitch) and may publish them without further notification. You are using this feature at your own risk and we are not liable for any use as you are responsible for what Alchemist will post through Discord.

10. Uploading Images

You are able to upload images from your device when using various Alchemist commands and features. You agree to only upload images you own or otherwise have sufficient intellectual property rights to use.
